A. Cancellation Policy

Introduction

Consumers are entitled to a right of withdrawal as described below. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire after fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last good.

To exercise your right of withdrawal, you must inform us (VON SCHÜTZ c/o HOOSA GmbH, Immengarten 4, 30926 Seelze, Germany, Tel.: +49 (0) 5137 14 923 72, Email: info@vonschutz.com) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods. The cost of returning goods that, by their nature, cannot normally be returned by post (freight goods) is estimated at a maximum of approximately 100 EUR for each such item.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive or which are clearly tailored to the consumer’s personal needs.

The right of withdrawal expires prematurely for contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons if they are unsealed after delivery.

Linked/Financed Transactions

If you finance this contract through a loan and later withdraw from it, you are no longer bound by the loan agreement if both contracts form an economic unit. This is particularly the case if we are also your lender or if your lender uses our cooperation to finance the agreement. If the loan has already been credited to us when the withdrawal becomes effective or the goods are returned, your lender will assume our rights and obligations under the financed agreement concerning you. This does not apply if the present contract concerns the acquisition of financial instruments (e.g., securities, foreign exchange, or derivatives). To avoid being contractually bound as much as possible, exercise your right of withdrawal and also withdraw from the loan agreement if you are entitled to a right of withdrawal for this purpose.

General Information

  1. Please avoid damaging or contaminating the goods. If possible, return the goods in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure sufficient protection against transport damage with suitable packaging.
  2. Please do not return the goods freight collect.
  3. Please note that the above points 1-2 are not prerequisites for the effective exercise of the right of withdrawal.
